1. Acceptance of terms
By accessing or using Digger ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Service. These terms apply to all users, including individual recruiters, recruitment agencies, and companies.
2. Description of service
Digger is an AI-powered Applicant Tracking System (ATS) and Candidate Relationship Management (CRM) platform. The Service includes candidate management, AI matching, pipeline management, analytics, and related features as described on our website. We reserve the right to modify, suspend, or discontinue any feature with reasonable notice.
3. Account registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized access. One person or legal entity may not maintain more than one free trial account.
4. Acceptable use
You agree to use the Service only for lawful recruitment purposes. You must comply with all applicable laws, including GDPR and local employment regulations. You may not: use the Service to discriminate against candidates, upload data you do not have the right to process, attempt to reverse-engineer the AI matching algorithms, resell access to the Service without authorization, or use the Service for automated scraping or data collection.
5. Data ownership
You retain ownership of all data you upload to Digger. We do not claim ownership of your candidate data, job descriptions, or other content. You grant us a limited license to process your data solely for the purpose of providing the Service. When you delete your account, we delete your data in accordance with our Privacy Policy.
6. AI-generated content
The Service uses AI to generate match scores, recommendations, and other outputs. AI-generated content is provided as a tool to assist your decision-making, not as a substitute for human judgment. We do not guarantee the accuracy of AI outputs. You are responsible for all hiring decisions made using the Service.
7. Pricing & billing
Pricing is as published on our Pricing page. Prices are in euros and exclude VAT unless stated otherwise. Subscriptions renew automatically unless cancelled. You may cancel at any time from your account settings. Refunds are not provided for partial billing periods. We may adjust pricing with 30 days notice.
8. Free trial
New accounts receive a 14-day free trial of Tier 1 features. A payment method is required to start the trial. At the end of the trial, you may subscribe to a paid plan or your account will be downgraded. Data created during the trial is preserved if you subscribe within 30 days.
9. Limitation of liability
To the maximum extent permitted by law, Digger is not liable for: indirect, incidental, or consequential damages, loss of data beyond our control, hiring decisions made based on AI recommendations, or service interruptions caused by force majeure. Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.
10. Termination
You may terminate your account at any time. We may terminate or suspend your account if you violate these terms, fail to pay, or if required by law. Upon termination, your right to use the Service ceases immediately. We will make your data available for export for 30 days after termination.
11. Governing law
These terms are governed by the laws of Belgium. Any disputes will be resolved in the courts of Belgium. If any provision of these terms is found unenforceable, the remaining provisions remain in effect.
12. Changes to terms
We may update these terms from time to time. We will notify you of material changes via email at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the new terms.
